1. Definitions

a) “We/Us” means Athena Web Designs Limited t/a Cirencester Locals

b) “You” means the seller.

c) “Seller” means any business that is selling products or services on the Cirencester Locals website.

d) “Buyer” means any individual, company or organisation that are purchasing goods or services using the Cirencester Locals website.

e) “Our/ours” belonging to or the property of Athena Web Designs ta/ Cirencester Locals.

2. Acceptance of terms

a) These Terms are a legally binding contract between you and Cirencester Locals. This contract sets out your rights and responsibilities when you use cirencesterlocals.co.uk, so please read them carefully.

b) We may update these seller terms and conditions from time to time and will re upload them to the website. You should review the seller terms periodically.

c) By using our website you’re agreeing to the terms. If you don’t agree with the terms, you may not have a seller’s account.

This website is owned and run by Athena Web Designs Ltd (Cirencester Locals) (“we”). Our company number is 07764523 and our registered office address is ​43 Dyer Street, Cirencester, Gloucestershire, GL7 2PP. Our VAT number is 181 171915.

4. Using our website/services

a) You must be 18 years or older to use our website. Minors under 18 and at least 13 years of age are only permitted to use our website through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision.

b) It is the sellers responsibility to check that all the details regarding your business, products or services on the website are correct.

c) You must treat any logins for the website confidentially and must not share or give them to any third parties. If we feel that you have not complied with this we have the right to disable any user that we feel may have become compromised.

d) It is the seller’s responsibility to check that all the details regarding your business, products or services on the website are correct.

e) All products added to the website are submitted for approval by Cirencester Locals. We aim to get the products approved within 48 hours but can not be held accountable for delays.

f) If for whatever reason a product or listing is deemed as unacceptable, Cirencester Locals reserve the right to reject the listing, where possible we will provide an explanation for rejecting the product.

g) Sellers must ensure that your contact details are listed within your shop on the website so that buyers can easily contact you if needed. It is not Cirencester Locals responsibility to act as a go between buyers and sellers.

h) Sellers must not include any content within the shop or anywhere on the website or social media page which is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive.

i) Sellers must not include any content that is false or misleading.

j) It is the sellers responsibility to ensure that their terms and conditions and privacy policy are on their product pages and are up to date and correct and that they themselves adhere to them.

k) The seller agrees that they will not break any laws in connection with their use of the Website. It is your responsibility to have the required licenses in place for your shop; you may not sell anything that breaks any laws.

l) You agree not to crawl, scrape, or spider any page of the website or to reverse engineer or attempt to obtain the source code of the website.

m) You agree not to tamper with or try to cause disruption to our website or services, for example, by using viruses or any other harmful computer code.

n) Cirencester Locals have the right to remove any content that a seller adds to the website at any time.

o) The seller’s business address must be located within Cirencester. If your business is located outside of Cirencester you will need to contact us prior to setting up an account to check if your address is eligible as we will also accept businesses from some of the surrounding areas.

5. Intellectual property rights

a) Cirencester Locals own the website, and are the licensee to, all right, title and interest in the website.

b) Anything that a seller adds to the website (like shop names, shop images, product photos and product descriptions belong to the seller.

c) Sellers are responsible for content and must ensure that they have all the necessary rights to use the content and must not violate any third party’s rights by using it.

d) If it is brought to our attention that copyright has been violated by the seller Cirencester Locals have the right to remove the content and depending on the severity of the violation the sellers account may be removed.

e) The seller agrees to Cirencester Locals using the content that the seller has added to the website to help promote both the Cirencester Locals website and the seller.

6. Warranties and Limitation of Liability

a) Cirencester Locals cannot be held responsible for delays in support or failure to provide a resolution to an issue that involves a third party service or product. 

b) We do not guarantee that:

  • The website will be secure or available at any particular time or location.
  • Any defects or errors will be corrected.
  • The website will be free of viruses or other harmful materials
  • The results of using the website will meet your expectations.

c) You use the website at your own risk.

d) To the fullest extent permitted by law, neither Cirencester Locals, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the services or these terms.

7. Payment Methods

a) At present this is a free service, however we reserve the right to review this at a later date.

b) All payments will go into Athena Web Designs Ltd’s PayPal account. We will then manually make payments to the relevant sellers. We will process manual payments twice a week (Monday and Thursdays). We cannot be held responsible for any delays in payment.

c) To cover PayPal’s charges the seller will be charged 2.9% of the order value plus 30p per transaction per order placed with them. If PayPal increases these fees the seller will need to pay any additional costs.

d) Sellers are to contact the buyers directly if there is a problem with payments.

e) Sellers are to be contacted directly by the buyers if they experience payment issues.

8. Delivery

a) Sellers should ensure that the correct delivery information is available on their shop.

b) It is the seller’s responsibility to adhere to their own delivery terms that are displayed on their shop.

c) Cirencester Locals cannot arrange delivery on the buyer or seller’s behalf.

d) Cirencester Locals are only able to take orders from shipping addresses within Cirencester and some of the surrounding areas. Please refer to the delivery page on the website for full details.

9. Returns 

a) Sellers are responsible for returns, it is their responsibility to include within their shop terms and conditions if returns are an option and if so how to go about it.

b) If a return is required, for whatever reason, this must be organised directly with the buyer.

c) Cirencester Locals cannot arrange this on the buyer or sellers behalf.

d) Refunds cannot be processed through the website and therefore they must be arranged by another means (such as PayPal) by the seller.

10. Buyer disputes

a) It is your responsibility to resolve any buyer disputes.

b) Although Cirencester Locals will not handle or intervene with buyer disputes they will monitor them and to protect the reputation of the website and other sellers Cirencester Locals reserve the right to remove any sellers who they deem to be receiving high levels of disputes.

11. Disputes with other Cirencester Locals sellers

a) If a seller has a dispute with another Cirencester Locals seller in regards to the website, they must take this up directly with the other seller.

b) Cirencester Locals are not responsible for settling disputes between sellers.

12. Termination of account

a) As this is a free service at present there is no notice period, if a seller wishes to close their account/shop, however the seller must notify Cirencester Locals so that they can remove the shop from the website.

b) The seller must ensure before closure that all orders have been fulfilled.

c) Cirencester Locals reserve the right to terminate or suspend a sellers account for any reason and without notice.

d) If a seller or Cirencester Locals terminate a sellers account it will result in the seller losing information associated with the account, including content.

c) Cirencester Locals can not be held responsible for any issues with payments.

a) Each seller has its own delivery information; please check this before making a purchase. This can be found on their product pages.

b) Any enquiries regarding delivery needs to be made directly with the seller, contact details can be found on their product pages.

c) Cirencester Locals cannot arrange delivery on the buyer or seller’s behalf.

9. Cancellations

a) Cirencester Locals does not process cancellations, these must be carried out directly with the seller.

b) Sellers may not allow cancellations so please check their terms and conditions on product pages.

10. Returns

a) Please refer to the relevant sellers terms and conditions listed on their product pages.

b) If a return is required, for whatever reason, this must be organised directly with the seller, their contact details can be found on their product pages.

c) Cirencester Locals cannot arrange this on the buyer or seller’s behalf.

d) Refunds cannot be processed through the website and therefore they must be arranged by another means (such as PayPal) by the seller.

11. Disputes with a Seller

a) Any disputes relating to a seller regarding an order through the website should be handled directly with them. If the dispute gets to a point where you feel that no solutions or an unfair solutions has been offered then there is an online dispute platform that you can visit by following this link https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN

b) Although Cirencester Locals will not handle or intervene with buyer disputes they will monitor them and to protect the reputation of the website and other sellers, Cirencester Locals reserve the right to remove any sellers who they deem to be receiving high levels of disputes. Email info@cirencesterlocals.co.uk to inform us of a dispute.

12. Termination of account

a) As this is a free service at present there is no notice period for terminated accounts.

b) If a buyer wishes to close their account they must notify Cirencester Locals so that they can remove their profile from the website.

c) Cirencester Locals reserve the right to terminate or suspend a buyer’s account for any reason and without notice.
